1. Consent to Communication

By submitting your phone number, email, or other contact information via any Apex platform, you consent to receive communications from us and/or our AI voice and messaging systems, including:

These communications may include scheduling reminders, account updates, service offerings, educational materials, or promotional campaigns. You acknowledge that such messages may be generated and delivered via automated technologies. You affirmatively opt-in to receiving these communications. You can opt out at any time by replying STOP to any message or contacting us directly.

2. Use of Services

You agree to use Apex services for lawful purposes only. You shall not:

Abuse, misuse, or manipulate any AI feature, Upload false, misleading, or illegal information, Interfere with service functionality or disrupt our systems

We reserve the right to terminate access to our systems and services if misuse or abuse is detected.

3. User Responsibilities

Users are solely responsible for ensuring that any information submitted through Apex systems is accurate, lawful, and up to date. You are prohibited from impersonating others, submitting fraudulent content, or using our platforms to spread misinformation.

4. AI Guidance Disclaimer

Our AI employees, including Apex Nova and LegalShield Lena, are trained assistants designed to support user interaction. However, they do not offer legal, financial, or professional advice. For specific recommendations, consultations with a licensed professional are required.

5. Third-Party Tools and Integrations

Apex may utilize or integrate third-party tools (e.g., CRM platforms, AI services, LegalShield resources). We are not responsible for the practices, performance, or availability of these third-party services. Any issues arising from third-party platforms must be resolved with the respective provider.

6. Refund & Cancellation Policy

Refunds for digital or service-based products (e.g., Launch Packages, ApexOS subscriptions) are handled on a case-by-case basis. By purchasing services, you agree to Apex's fulfillment timeline, terms of engagement, and performance expectations. Cancellations must be submitted in writing to our support team.

7. Limitation of Liability

Apex shall not be liable for indirect, incidental, consequential, or punitive damages arising out of your use of our services or interactions with our AI systems.

8. Governing Law & Jurisdiction

These Terms shall be governed by and interpreted in accordance with the laws of the State of Illinois. All disputes arising under these Terms shall be resolved exclusively in the courts located in Cook County, Illinois.

9. Dispute Resolution

In the event of any dispute, claim, or controversy arising out of or relating to the services provided by Apex, both parties agree to first attempt resolution through informal negotiation. If unresolved, the matter shall be submitted to binding arbitration in Chicago, Illinois, under the rules of the American Arbitration Association. The arbitration decision shall be final and enforceable by any court of competent jurisdiction.

10. Changes to Terms

We may update or revise these Terms at any time. Continued use of our services after changes constitutes acceptance.
